1. Our Commitment to Preventing Spam
1.1 Zero Tolerance. MaileniumAI has a zero-tolerance policy for spam. We are committed to:
- Preventing spam and abusive email practices on our platform
- Maintaining high email deliverability rates for all users
- Protecting recipients from unsolicited and unwanted emails
- Complying with all applicable anti-spam laws and regulations
- Taking swift action against users who violate this Policy
- Educating users about best practices for legitimate email marketing
1.2 Platform Integrity. We actively monitor email sending practices, spam complaint rates, bounce rates, and other metrics to identify and prevent spam. We use automated systems and manual review to detect and address spam-related issues promptly.
1.3 Industry Standards. We follow industry best practices and standards for email deliverability, including maintaining proper email authentication (SPF, DKIM, DMARC), monitoring sender reputation, and implementing rate limiting and throttling to prevent abuse.
2. What Constitutes Spam?
2.1 Definition of Spam. Spam is any unsolicited bulk email that violates anti-spam laws or email marketing best practices. For purposes of this Policy, spam includes, but is not limited to:
- Unsolicited Commercial Email: Emails sent to recipients who have not given explicit consent to receive commercial messages from you.
- Purchased or Rented Email Lists: Sending emails to addresses obtained from purchased, rented, or harvested email lists.
- Harvested Email Addresses: Sending emails to addresses collected through automated means (web scraping, email harvesting tools, etc.) without consent.
- Misleading Headers or Subject Lines: Emails with deceptive "From" addresses, subject lines, or content designed to mislead recipients about the sender or content.
- Phishing or Fraudulent Emails: Emails designed to trick recipients into revealing sensitive information or engaging in fraudulent activities.
- Malware or Virus Distribution: Emails containing malicious attachments, links to infected websites, or other harmful content.
- Violation of Unsubscribe Requests: Sending emails to recipients who have unsubscribed or requested to be removed from mailing lists.
- Excessive Sending: Sending emails in volumes that exceed reasonable usage patterns or that cause delivery issues or complaints.
- Low-Quality Content: Emails with poor content quality, excessive use of spam trigger words, or content that is likely to be flagged as spam by email filters.
2.2 Indicators of Spam. The following are indicators that emails may be considered spam:
- High spam complaint rates (typically above 0.1% or 1 complaint per 1,000 emails)
- High bounce rates (typically above 5% for hard bounces)
- Low engagement rates (very low open rates, click rates, or high unsubscribe rates)
- Recipients reporting emails as spam through their email clients
- Blacklisting of sending domains or IP addresses
- Violations of email authentication (SPF, DKIM, DMARC failures)
- Patterns consistent with automated or bulk sending without proper consent
3. Prohibited Practices
3.1 Strictly Prohibited Activities. The following activities are strictly prohibited when using MaileniumAI:
- Using Purchased, Rented, or Harvested Lists: You may not send emails to addresses obtained from purchased lists, rented lists, or email harvesting. All contacts must have provided explicit consent to receive emails from you.
- Adding Contacts Without Consent: You may not add contacts to your mailing lists without their explicit consent. Consent must be obtained through opt-in forms, double opt-in, or other legitimate means.
- Ignoring Unsubscribe Requests: You must honor all unsubscribe requests immediately and permanently. You may not send emails to unsubscribed addresses or attempt to re-add them to mailing lists.
- Deceptive Practices: You may not use misleading sender information, subject lines, or content. All emails must accurately identify the sender and provide clear, honest information.
- Phishing or Fraud: You may not send emails designed to trick recipients into revealing sensitive information, clicking malicious links, or engaging in fraudulent activities.
- Malware Distribution: You may not send emails containing viruses, malware, or other harmful content.
- Spam Trigger Words: You should avoid excessive use of spam trigger words (e.g., "FREE", "CLICK HERE", "URGENT", "ACT NOW") that may cause emails to be flagged as spam.
- Excessive Sending: You may not send emails in volumes that exceed reasonable usage patterns, cause delivery issues, or result in high complaint rates.
- Circumventing Limits: You may not attempt to circumvent sending limits, rate limits, or other restrictions by creating multiple accounts or using automated systems.
- Violating Anti-Spam Laws: You may not send emails that violate applicable anti-spam laws, including CAN-SPAM Act, CASL, GDPR, or other regulations.
4. Required Practices
4.1 Consent Requirements. You must obtain explicit consent from all recipients before sending marketing emails. Consent must be:
- Explicit and Informed: Recipients must clearly understand that they are consenting to receive marketing emails from you.
- Freely Given: Consent must be voluntary and not coerced or required as a condition of service.
- Specific: Consent should specify what types of emails recipients will receive.
- Documented: You must maintain records of consent, including when and how consent was obtained.
- Revocable: Recipients must be able to withdraw consent at any time (unsubscribe).
4.2 Unsubscribe Requirements. All marketing emails must include:
- Clear Unsubscribe Link: A prominent, working unsubscribe link that is easy to find and use.
- One-Click Unsubscribe: Recipients should be able to unsubscribe with a single click, without requiring additional steps or information.
- Immediate Processing: Unsubscribe requests must be processed immediately (within 10 business days maximum, though we process them instantly).
- Permanent Removal: Unsubscribed addresses must be permanently removed from mailing lists and added to suppression lists.
4.3 Sender Identification. All emails must clearly identify:
- The sender's name or business name
- A valid, monitored email address for replies
- Physical mailing address (as required by CAN-SPAM Act and other laws)
- Accurate "From" and "Reply-To" addresses
4.4 Email Authentication. You must properly configure email authentication:
- SPF (Sender Policy Framework): Configure SPF records to authorize email sending from your domain.
- DKIM (DomainKeys Identified Mail): Set up DKIM signing to cryptographically sign emails and verify sender authenticity.
- DMARC (Domain-based Message Authentication): Implement DMARC policies to protect against email spoofing and phishing.
4.5 List Hygiene. You must maintain clean mailing lists by:
- Removing bounced email addresses immediately
- Removing unsubscribed addresses permanently
- Removing inactive or unengaged contacts periodically
- Validating email addresses before sending
- Monitoring and addressing spam complaints promptly
5. Compliance with Anti-Spam Laws
5.1 Applicable Laws. You must comply with all applicable anti-spam laws and email marketing regulations, including but not limited to:
- CAN-SPAM Act (United States): Requires opt-out mechanisms, accurate sender information, prohibits deceptive subject lines, and mandates physical mailing addresses in commercial emails.
- CASL (Canada): Requires express consent for commercial emails, includes strict requirements for unsubscribe mechanisms, and imposes significant penalties for violations.
- GDPR (European Union): Requires lawful basis for processing, explicit consent for marketing emails, data subject rights, and data protection by design.
